Service Agreement
This agreement outlines the terms, responsibilities, and expectations for care services provided by A Pearl's Journey Home Care.
Effective date: September 17, 2026
This document governs the relationship between A Pearl's Journey Home Care and our clients. A signed copy of this agreement will be provided to each client prior to the start of services. If you have any questions, please call us at (463) 202-4773 before services begin.
Parties to This Agreement
This Service Agreement ("Agreement") is entered into between A Pearl's Journey Home Care ("Agency") and the client and/or their authorized representative ("Client"). By engaging our services, the Client agrees to the terms set forth in this Agreement.
Scope of Services
The Agency agrees to provide non-medical personal care and companion services as outlined in the Client's individualized care plan. Services may include, but are not limited to:
Care Plan & Individualized Services
Prior to the commencement of services, the Agency will conduct an initial assessment to develop a personalized care plan tailored to the Client's needs, preferences, and goals. The care plan will be reviewed and updated as the Client's needs change. The Client or their representative may request modifications to the care plan at any time by contacting the Agency.
Caregiver Assignment
The Agency will assign qualified, trained caregivers to the Client. While the Agency will make reasonable efforts to maintain consistency in caregiver assignments, the Agency reserves the right to reassign caregivers as necessary due to scheduling, availability, or other operational needs. The Client will be notified of any caregiver changes in advance whenever possible.
Scheduling & Hours of Service
Services will be provided on the days and hours agreed upon in the care plan. Any changes to the schedule must be communicated to the Agency with a minimum of 24 hours' notice. The Agency will make reasonable efforts to accommodate schedule changes but cannot guarantee availability on short notice.
Fees & Payment
Service fees will be outlined in the Client's individualized care plan and rate agreement. Fees are due as specified in the billing schedule provided at the time of enrollment. The Agency accepts payment by check, electronic funds transfer, and other methods as agreed. Invoices not paid within the specified period may be subject to a late fee. The Agency reserves the right to adjust rates with a minimum of 30 days' written notice.
Cancellation Policy
The Client may cancel a scheduled visit by providing at least 24 hours' advance notice. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee as outlined in the rate agreement. The Agency reserves the right to cancel or reschedule visits due to caregiver illness, inclement weather, or other circumstances beyond its control, and will make every effort to provide a replacement caregiver.

Confidentiality & Privacy
The Agency is committed to protecting the privacy of all Client information. All personal, health, and financial information shared with the Agency will be kept strictly confidential and used solely for the purpose of providing care services. The Agency will not disclose Client information to third parties without written consent, except as required by law. Please refer to our Privacy Policy for full details.
Non-Medical Nature of Services
All services provided under this Agreement are non-medical in nature. The Agency's caregivers are not licensed medical professionals and will not provide medical advice, diagnosis, treatment, or skilled nursing care. For medical needs, the Client should consult a licensed healthcare provider. Please refer to our Non-Medical Disclaimer for full details.
Termination of Services
Either party may terminate this Agreement with a minimum of 14 days' written notice. The Agency reserves the right to terminate services immediately in cases involving unsafe conditions for caregivers, non-payment, or conduct that violates the terms of this Agreement. Upon termination, the Client will be billed for all services rendered through the final date of care.
Limitation of Liability
The Agency's liability for any claim arising from the provision of services shall be limited to the fees paid for the specific services giving rise to the claim. The Agency shall not be liable for indirect, incidental, or consequential damages. The Agency is not responsible for loss or damage to Client property unless caused by the gross negligence or willful misconduct of an Agency caregiver.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana. Any disputes arising under this Agreement shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to mediation before any legal action is pursued.
Amendments
The Agency reserves the right to amend the terms of this Agreement with 30 days' written notice to the Client. Continued use of services after the effective date of any amendment constitutes acceptance of the revised terms.
